1. Who you are buying from
big hair affair is a brand of capXholding AG, Oberallmendstrasse 18, 6300 Zug, Switzerland (company number CHE-493.168.511), email your@bighairaffair.com. In these terms, "we" and "us" mean capXholding AG. Our products ship from our warehouse in Germany.
These terms apply to every order placed in this online shop. The shop is made for consumers: people who buy for purposes outside their trade, business or profession. If you order as a business, the consumer rights described here (in particular the right of withdrawal in section 7) do not apply to you.
2. Ordering
The products shown in the shop are an invitation to order, not yet a binding offer. You can check and correct your order in the cart and again on the payment page, until you press the pay button. By paying you place a binding order. The contract between you and us comes into being when we confirm your order, which we do on the confirmation page and by email directly after your payment.
If we cannot accept an order, for example because the last unit was sold in the same moment, we tell you without delay and refund in full anything you have already paid. The contract is concluded in English. We keep a record of your order and send you its details by email. The version of these terms that applied to your order is the one published here on the day you ordered.
3. Prices, taxes and import charges
All prices are in euros and are final prices for deliveries within the European Union: they include any value added tax that applies. Shipping costs depend on the destination and are shown in the cart and on the payment page before you pay.
Deliveries to destinations outside the customs territory of the European Union (Andorra, Australia, Bahrain, Canada, Chile, Faroe Islands, Gibraltar, Guernsey, Hong Kong, Iceland, Isle of Man, Israel, Japan, Jersey, Kuwait, Liechtenstein, Malaysia, Mexico, New Zealand, Norway, Oman, Qatar, San Marino, Saudi Arabia, Singapore, South Africa, South Korea, Switzerland, Taiwan, Thailand, United Arab Emirates, United Kingdom, United States, Vatican City) cross a customs border. For these destinations our prices do not include import duties, import taxes or the carrier's customs clearance fees. They are charged by the carrier or the authorities when the parcel arrives and are paid by the recipient. We say so in the cart and on the payment page before you pay. We have no influence on these charges; your local customs office can tell you what to expect. If a parcel comes back to us because import charges were not paid, we treat that as a withdrawal from the contract (section 7).
4. Payment
Payment is processed by Stripe on Stripe's secure payment page, with the payment methods offered there for your country. Your payment method is charged when you place the order. This also applies to pre-orders (section 6). We never see or store your full card details.
5. Delivery
We deliver to the countries listed below and to no others; the cart only accepts these destinations. Products that are in stock leave our warehouse within 3 working days after your order. From there, delivery usually takes:

These times are estimates; customs clearance outside the European Union can add to them. Pre-orders follow section 6 instead. If a parcel cannot be delivered and comes back to us, we contact you to arrange a new delivery or a refund.
6. Pre-orders
A product offered for pre-order is not in stock yet. Wherever we offer it (on the product page, in the pre-order panel, on the payment page and in your confirmation email) we name the date by which it will leave our warehouse at the latest. That date is part of our contract with you. The dates we currently promise: bIG hAIR, ships by 31 March 2027. The date that applies to you is the one shown when you ordered.
- You pay the full price when you place the pre-order. The price you paid is final, whatever the product costs later.
- You can cancel a pre-order at any time before it ships, without giving a reason, and get a full refund. Use the withdrawal page or write to your@bighairaffair.com. We refund to the payment method you used, without delay and within 14 days at the latest.
- If we cannot ship by the promised date, we tell you before that date passes and name a new one. You do not have to accept it: your right to cancel for a full refund stays as it is.
- A pre-order is its own order with its own payment. It cannot be combined with products that are in stock.
- Your right of withdrawal (section 7) is not shortened by pre-ordering: its 14 days only start when you receive the product.
7. Your right of withdrawal
If you are a consumer you have the following right of withdrawal. We grant it to customers in every country we deliver to; where the law of your country gives you more, you keep that as well.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods (if your order is delivered in several parcels: of the last of them).
To exercise the right of withdrawal, you must inform us (capXholding AG, Oberallmendstrasse 18, 6300 Zug, Switzerland, email your@bighairaffair.com) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.
You can also exercise your right of withdrawal online at https://bighairaffair.com/withdraw. If you use this online function, we will send you an acknowledgment of receipt on a durable medium (for example by email) without undue delay, stating the content of your withdrawal and the date and time we received it.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to our warehouse in Germany; we send you its return address by email as soon as we have received your withdrawal, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
When there is no right of withdrawal
The right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery.
8. If something is wrong with your order
You have the statutory rights that apply when goods are defective or not as described. Write to your@bighairaffair.com with your order number and, if you can, a photo: a damaged, leaking or wrong product is replaced or refunded at our cost. Nothing in these terms limits those rights.
9. Using our products
Our products are cosmetics for external use on hair and scalp. They are not medicines and are not meant to diagnose, treat or cure any condition. Read the instructions, the ingredient list and the warnings on the packaging before use, try a new product on a small area of skin first, and stop using it if your skin reacts. If you have a scalp or skin condition, are pregnant or breastfeeding, or are unsure whether an ingredient is right for you, ask a doctor or pharmacist first. Results differ from person to person.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under mandatory product liability law, and where we have given a guarantee. For slight negligence we are liable only if we breach an obligation that is essential to the contract, that is, one you rely on and may rely on for the contract to be carried out at all; in that case our liability is limited to the damage that is typical and foreseeable for this kind of contract. Beyond that, our liability is excluded to the extent the law allows.
11. Your data
We use your data to process your order: payment (Stripe), delivery (our warehouse and the carrier) and the emails that belong to it. Details are in our privacy notice.
12. Applicable law and disputes
Swiss law applies, without the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not take away the protection of the mandatory rules of the country where you live, and you can bring claims before the courts of that country.
If something goes wrong, write to us first: we would rather fix it than argue about it. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
13. Changes to these terms
We may change these terms for future orders. Your order is always governed by the version that was published here on the day you placed it. If a provision of these terms is or becomes invalid, the rest remains in force.
